Section 3. Credit Card and Banking Information, Use and Storage
Case of Success, Co. does not have access to and / or store customer credit card numbers or checking account bank information. Payments made for goods are verified by PayPal Merchant Account solutions thereby giving Case of Success, Co. only confirmation of payment acceptance or denial. Order processing decisions relating to initial and / or final order payment acceptance or denial are the sole decision of Case of Success, Co. owner(s) and / or representatives.
Section 4. Order Payment Processing / Immediate Payment Conditions
Case of Success, Co. will not initiate the final debit (capturing of funds) from any individual customer submitted credit card, checking account or PayPal funds payment for order(s) until the date of shipment of goods for any order, or simultaneously open orders for a unique individual or entity, totaling $200.00 USD or less. Under the condition of any individual submitting a single and / or multiple orders resulting in in-process orders for goods collectively exceeding $200.00 USD payment may be collected in full at any time and at our sole discretion during order processing and before shipment of goods. Any submitted order payment for goods totaling an excess of $200.00 USD is subject to immediate final debit (capturing of funds) at any time during order processing and before shipment of goods.
Section 5. Fraudulent and / or Suspected Fraudulent Activities
Case of Success, Co. reserves the right to refuse to process any order at any time for any reason or no reason at all. Denied order notification is by e-mail communication only. Payments are not collected for suspected fraudulent orders. Repeat attempts of submitting orders for processing by any individual or entity for whom or which orders previously resulted in a denied status may result in IP address based access restriction to the CastillionBay.com website. We reserve the right to deny service to any individual or entity as we deem necessary for suspected fraudulent activity and / or for any reason or no reason at all. Case of Success, Co. will comply with and pro-actively participate with any and all banking and / or law enforcement officials regarding any fraudulent and / or suspected fraudulent activities.
Section 6. Taxes for Washington State Residents
Case of Success, Co. does not charge retail sale tax(es) applicable to Washington State consumers purchasing goods for orders placed via CastillionBay.com. Case of Success, Co. calculates quarterly and / or annual retail sales tax amounts to voluntary remit differences to the Washington State Department of Revenue.
Section 7. No Representations or Warranties; Limitations on Liability
The information and materials on the website could include technical inaccuracies or typographical errors. Changes are periodically made to the information contained herein. Case of Success, Co. makes no representations or warranties with respect to any information, materials or graphics on the website, all of which is provided on a strictly "as is" basis, without warranty of any kind and hereby expressly disclaims all warranties with regard to any information, materials or graphics on the website, including non-infringement. The implied warranties of merchantability and fitness for a particular use are specifically excluded only in circumstances in which you may exercise your right to a complete product refund pursuant to our Customer Satisfaction Guarantee. Under no circumstances shall Case of Success, Co. owner or publisher be liable under any theory of recovery, at law or in equity, for any damages, including without limitation, special, direct, incidental, consequential or punitive damages including but not limited to loss of use or lost profits, arising out of or in any manner connected with the use of information or services, or the failure to provide information or services, from the website.
